This policy explains what personal information we collect when you visit sophieandemily.com or place an order, what we do with it, who we share it with, and what choices you have.

1. Who we are

Sophie & Emily is operated by H Marketing LLC, which is responsible for the personal information described in this policy.

Our customer service team reads this inbox Monday to Friday, 9:00 AM to 6:00 PM, and Saturday and Sunday, 10:00 AM to 3:00 PM (GMT-5). You can send a message through our contact form at any hour, and we reply within 24 hours.

Because we operate exclusively online and deal with you directly, email is our designated method for privacy requests.

2. What we collect

Information you give us

  • Name, email address, delivery address, billing address and telephone number when you place an order.
  • The contents of your order, including sizes and colours.
  • Anything you write to us through the contact form or by email, including your name, email address and the message itself.
  • Your email address if you subscribe to our emails or enter a promotion.

We do not receive or store your full card number. Card details go directly to our payment provider. We see only the card type, the last four digits, and whether the payment succeeded.

Information collected automatically

  • Device and browser information, IP address, operating system, and the site you arrived from.
  • Pages you view, products you look at, what you add to your cart, and how you move through the store.
  • Cookie identifiers, described in section 5.

Information from others

  • Delivery status from the carrier handling your parcel.
  • Confirmation of payment, and the outcome of fraud checks, from our payment provider.

3. Categories of personal information

Over the past twelve months we have collected the following categories, and disclosed them to the service providers listed in section 6. We have not sold personal information for money.

We do not collect biometric information, precise geolocation, or the categories that state law treats as sensitive personal information, and we do not use or disclose personal information for purposes other than those described here.

4. Why we use it

  • To process, fulfil and deliver your order, and to handle returns and refunds.
  • To answer your questions and provide customer service.
  • To prevent fraud, abuse and unauthorised use of payment methods.
  • To keep the accounting and tax records we are legally required to keep.
  • To send you marketing emails, if you have asked to receive them.
  • To understand how the store is used, and improve it.
  • To measure our advertising and show you our products on other sites.

We do not make decisions about you by automated means that produce legal effects for you.

5. Cookies and similar technologies

We use cookies and comparable technologies in four groups:

  • Strictly necessary. Keeping your session alive, remembering your cart, and running the checkout. These cannot be switched off, because without them the store does not work.
  • Functional. Remembering preferences such as your chosen size.
  • Analytics. Understanding which pages and products people visit, so we can improve them.
  • Advertising. Measuring the results of our advertising, and showing you our products on other sites.

You can manage cookies through your browser settings. Blocking strictly necessary cookies will stop the store from working properly.

If your browser sends a Global Privacy Control signal, we treat it as a request to opt out of the sharing of personal information for targeted advertising.

6. Who we share it with

We do not sell your personal information for money. We share it with the following service providers, only as far as they need it to do their work for us:

  • Shopify Inc., which hosts this store and processes orders on our behalf.
  • Our payment providers, who take your payment and run fraud checks. Depending on how you pay, this may include Shopify Payments, Apple, Google or Shop Pay.
  • ParcelPanel, which provides order tracking on our site.
  • hCaptcha, which protects our contact form from automated abuse.
  • Carriers and fulfilment partners, who need your name, address and telephone number to deliver your parcel.
  • Analytics and advertising providers, where you have not opted out.
  • Professional advisers and authorities, where we are legally required to disclose information, or need to establish or defend a legal claim.

If our business is ever sold or transferred, personal information may transfer as part of that sale, subject to this policy.

7. Where your information is processed

We are based in the United States, and your information is processed there. Some of our service providers process data in other countries. Where that happens, we require them by contract to protect it to the standard described in this policy.

8. How long we keep it

  • Order and transaction records: seven years, to meet federal and state tax and accounting requirements.
  • Customer service correspondence: two years after the matter is closed.
  • Marketing contact details: until you unsubscribe, and for a short period afterwards so that we can honour the unsubscribe.
  • Cookie and analytics data: up to two years, depending on the cookie.

When we no longer need personal information, we delete it or anonymise it.

9. Security

Data submitted to this site travels over an encrypted TLS connection. Our payment provider is certified to PCI DSS Level 1. Access to customer information is limited to the people who need it to do their work.

No system is completely secure. If a breach occurs that presents a risk to you, we will notify you and the relevant authorities as the law requires.

10. Your choices and rights

Depending on where you live, you may have the right to:

  • know what personal information we have collected about you, and why;
  • receive a copy of that information;
  • have inaccurate information corrected;
  • have your information deleted;
  • opt out of the sharing of your information for targeted advertising;
  • limit how we use sensitive personal information;
  • not be treated differently for exercising any of these rights.

These rights are available to residents of California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana and other states with comparable laws, and we extend them to all our customers regardless of state.

How to exercise them. Email support@sophieandemily.com with what you would like us to do. We respond within 45 days, and will tell you if we need longer. We may ask you to confirm your identity first, so that we do not hand your information to someone else. You can use an authorised agent, and we may ask that agent for proof of authorisation.

If we decline, we will tell you why, and you may ask us to reconsider by replying to the same address.

Opting out of targeted advertising. Use our Your Privacy Choices page, or send a Global Privacy Control signal from your browser.

Visitors from the EEA and the United Kingdom. Our store is intended for customers in the United States. If you contact us from the EEA or the UK, you may also have the right to object to processing, to restrict it, to receive your information in a portable format, and to withdraw consent at any time. Write to us at the address above and we will treat your request the same way.

11. Marketing

Unsubscribe using the link at the bottom of any marketing email, or write to us. We will still send messages about orders you have placed, because those are not marketing.

12. Children

This store is not aimed at children, and we do not knowingly collect personal information from anyone under 16. If you believe a child has given us their information, write to us and we will delete it.

13. Changes to this policy

We update this policy when our practices change. The date at the top shows when it was last revised. If a change materially affects you, we will say so on the site.
